Acceptance

By installing or using Tactus MK1, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not download or use the App.

Beta Software

Tactus MK1 is currently distributed as a beta through Apple TestFlight. The App is provided as-is during this beta period. It may contain bugs, experience downtime, or change significantly — including feature additions, removals, or breaking changes — before any general release. We make no guarantees about stability or continued availability during the beta.

License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Tactus MK1 on iOS devices you own or control, solely for your personal, non-commercial use. You may not sublicense, sell, rent, distribute, or otherwise transfer the App or your rights under this license to any third party.

Your Content

Sounds, samples, and projects you create or record within Tactus MK1 remain yours. We do not claim ownership over content you generate using the App. You are solely responsible for ensuring that any audio, samples, or other material you record or import into the App does not infringe the rights of any third party, including copyright, trademark, or other intellectual property rights.

Acceptable Use

You agree to use Tactus MK1 only for lawful purposes and in accordance with these Terms. You must not:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Modify, adapt, translate, or create derivative works based on the App.
• Use the App in any way that violates applicable laws or regulations.
• Interfere with or disrupt the integrity or performance of the App.

Disclaimer of Warranties

Tactus MK1 is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of bugs, especially during the beta period.

Limitation of Liability

To the fullest extent permitted by applicable law, Excello Digital and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or business interruption — arising from your use of or inability to use Tactus MK1, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the App will not exceed the amount you paid for the App in the twelve months preceding the claim.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
